Terms of Service

These Terms of Service govern your use of eternalpawtraits.com and any commission services provided by Eternal Pawtraits, operated by Kayla Panaro, located in New Jersey, USA. By submitting a consultation request or commissioning a portrait, you agree to these terms in full.

1. Services Provided

Eternal Pawtraits offers custom hand-painted and digital pet portraits in a variety of mediums including Oil Painting, Acrylic, Pencil and Charcoal, and Digital Art. All portraits are custom commissioned and created by Kayla Panaro.

2. Consultation Process

Submitting a consultation request through our website does not constitute a binding agreement or guarantee of service. A commission is only confirmed once both parties have agreed on the portrait details, pricing, and timeline, and the required deposit has been received.

3. Pricing

All pricing is custom and determined during the consultation based on the chosen medium, size, complexity, and subject matter. Portraits can range from $50 to $1,000 and above. A final price will be agreed upon before any work begins.

4. Deposit & Payment

A non-refundable 30% deposit is required to begin any commission. This deposit covers the cost of upfront supplies and materials necessary to start your portrait. The remaining balance is due in full upon completion of the portrait and before delivery, shipping, or transfer of digital files.

Failure to pay the remaining balance may result in the portrait being withheld until payment is received.

5. Revisions

One revision opportunity is offered after the initial sketch is completed for all mediums. The client must review and approve the sketch before work proceeds to the final portrait. Once the sketch has been approved and the final portrait is completed, no further revisions will be made. It is the client's responsibility to communicate any concerns clearly during the revision stage.

6. Turnaround Time

Estimated turnaround times are provided during the consultation and vary by medium. Digital portraits typically take 3 to 5 weeks. Oil paintings may take 3 to 5 months due to the nature of the medium. These are estimates and not guarantees. Delays due to supply availability, complexity, or other unforeseen circumstances will be communicated promptly.

7. Reference Photos

The client is responsible for providing clear, high quality reference photos of their pet. Eternal Pawtraits is not responsible for limitations in the final portrait that result from poor quality, blurry, or insufficient reference photos. Guidance on suitable photos will be provided during the consultation.

8. Ash Incorporation

For clients who wish to incorporate their pet's ashes into the artwork, an additional fee applies. The client is responsible for shipping the ashes safely to Eternal Pawtraits, or arranging a local drop-off or delivery within 45 minutes of Matawan, New Jersey. Any remaining ashes will be returned to the client safely and respectfully upon completion of the portrait. Eternal Pawtraits handles all ashes with the utmost care and respect.

9. Delivery & Shipping

Physical portraits may be collected via free pickup in Matawan, New Jersey, delivered locally within 45 minutes of Matawan for a small transportation fee, or shipped to any location at the client's expense. Eternal Pawtraits is not responsible for damage or loss that occurs during third party shipping. Digital portraits are delivered as high resolution files via email.

10. Cancellations & Refunds

The 30% deposit is non-refundable under all circumstances as it covers materials already purchased. If a client wishes to cancel after work has begun, the deposit will not be returned. If a commission is cancelled before work has begun but after the deposit has been paid, the deposit remains non-refundable. Eternal Pawtraits reserves the right to cancel a commission at any time and will refund any payments beyond the deposit if cancellation is initiated by the artist.

11. Intellectual Property

All artwork created by Eternal Pawtraits remains the intellectual property of Kayla Panaro. By commissioning a portrait, the client receives a personal use license for the artwork. Eternal Pawtraits reserves the right to photograph, display, and share completed portraits on social media, the website, and in marketing materials unless the client explicitly requests otherwise in writing prior to the start of the commission.

12. Limitation of Liability

Eternal Pawtraits shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the total amount paid by the client for the specific commission in question.

13. Governing Law

These Terms of Service are governed by the laws of the State of New Jersey, USA. Any disputes arising from these terms shall be resolved in the appropriate courts of New Jersey.

14. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services following any changes constitutes acceptance of the updated terms.
